Definitions

The SUSHI DAILY customer feedback program is referred to as the Feedback Survey” or the Hello Customer program. “You” or “Your” means any person who participates in the Hello Customer program (a “Participant”). KellyDeli Company Limited is referred to herein as “We”, “Us” “Their”, “Our” or “the Promoter”. These Terms & Conditions, in their entirety are referred to as “Terms & Conditions” and “Terms”. 

Introduction

Kelly Deli Company Limited of 91-93 Great Eastern Street, London EC2A3HZ has retained Insider Metrics NV of Zuiderpoort, Gaston Crommenlaan 14/C1.1 9050 Ghent (Ledeberg) ("Hello Customer") to manage their customer feedback program.

By completing the Feedback Survey, You agree to be bound by these Terms so please read them carefully. We reserve the right to amend the Terms at any time by posting changes online. As a Participant, it is Your responsibility to review the Terms regularly to ensure that You are aware of any changes made and that You agree to them.

Prize Draw Terms & Conditions

Our prize draws are run and administered by Hello Customer. We will manage directly the relationship with the Winner.

Prize draws are open to Participants resident in the United Kingdom and aged 18 or over.

Employees of the Promoter, any associated company, their agents, immediate families, anyone entitled to Partner benefits, or anyone professionally connected with the promotion are not eligible for entry into any prize draw.

[Customers who have opted out of marketing communications from Sushi Daily website will not be informed of the prize draw within the invitation email for the survey and will not be eligible for participation as promoting the prize draw within the email would constitute a marketing communication and would directly conflict with the customer’s stated preferences.]

Twice a year, the prize draw covers a period, starting from the 1st of April of the year and finishing on the 30th of June of the year and starting from the 1st of October of the year to the 30th of November of the following year (Periods).  The Promoter reserves the right to hold, cancel, suspend this program where it becomes necessary to do so. All survey responses collected from customers eligible for participation within the time period will be eligible for the Period's prize draw. Any attempt by a participant to obtain more than one entry by using multiple surveys, email addresses, or any other methods will void that participant's entries, and that participant may be disqualified at The Promoter's discretion. For clarity, only one review entry per person per product over each Period is accepted.

To enter into the Prize draw, entrants will be required to have to submit their email address willingly and completed the online review form on the following link [link]during the Period. All mandatory details as highlighted on the review form should be completed to ensure that the submission can be processed effectively. 

Entries must be submitted through the link found on the Osaka Bay Club email titled Free £100 Amazon Gift Card or via the bottom section of Osaka Bay Club emails.

There will be one winner (the “Winner”) selected in each Period from all of the valid submitted entries to the Feedback Survey during that Period. The Winner will receive a £100 worth e-gift card to spend at Amazon.

The Winner will be drawn randomly via random.org on the first Monday following the end of a Period and details of the Winner will then be sent to the Promoter. The Winner will be notified by a member of the Promoter Marketing team by email within 14 days of the prize draw taking place during the relevant Period.

If any Winner fails to claim their Prize within 14 days of being notified, the Promoter reserves the right to award the Prize to an alternative winner.

Winners will receive their prize via the email address provided at the entry.

It is the responsibility of each prize draw participant to ensure that that they are able to accept prizes as set out and in accordance with these Terms. In the event they are unable to do so the Promoter reserves the right to re-award the prize to another eligible Participant.

The name of the prize draw Winners may be obtained by sending a stamped self-addressed envelope to “address of the independent person " or by email at the following address “osakabayclub@sushidaily.com “within thirty (30) days of the relevant prize draw closing date.

All prizes are non-transferable and there is no alternative (cash or otherwise) for any prize in whole or part save that the Promoter reserves the right to provide a prize of equal or greater value if a named prize is unavailable for any reason.

The Promoter accepts no responsibility to participants or any third party for loss of opportunity due to rejection of incomplete or incorrect submissions.

Entry into a prize draw constitutes each Participant’s acceptance of these Terms and the survey specific prize draw terms and conditions.

Personal data supplied during the course of this promotion will only be processed as set out in The Promoter’s privacy policy [insert link]. All personal data provided will be destroyed once the Winner has received their prize.

We will not use the information you have supplied for any other marketing campaign or pass it on to a third party unless you have opted in to receive marketing updates from Us.

We reserve the right to amend these prize draw Terms and will use reasonable endeavours to notify changes to entrants and potential entrants. We reserve the right, to exclude an entry to any prize draw for failure to comply with any of these Terms.

Sushi Daily Rewards

  1. The Promoter

The loyalty program is operated by KellyDeli Company Limited, a company with registration number 08765553, whose registered office is at 91-93 Great Eastern Street, London, United Kingdom, EC2A 3HZ (the “Promoter”).

  1. Terms
    1. These terms, together with the privacy policy [https://sushidaily.com/gb-en/privacy/] (the “Privacy Policy”) and the cookie policy [https://sushidaily.com/gb-en/cookies-policy/] (the “Cookie Policy”), which together shall be referred to as the Terms, apply to participation in the Promoter’s Loyalty program as defined below.

The Terms shall prevail in the event of any conflict or inconsistency with any other communications or Promoter terms, including any other Promoter communications which shall include advertising or programal materials.

2.2 Please read these Terms carefully. The Promoter may modify the Terms from time to time. By participating in this Loyalty program, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or participate in the Loyalty program.

  1. How to enter
  1. The Loyalty program will be held from 7th January 2023 to June 2023 in 10 kiosks: Barnet, Billericay, Brent cross, Buckhurst Hill, Finchley, Mill Hill, Southend, Welwyn Garden City, Whetstone, Canary Wharf.
  2. The Loyalty program will be available to UK residents only and aged 18 or over (“You” or “the Participant”) 
  3. Loyalty program is free but a purchase including online purchase is necessary and internet access is required to participate.
  4. To enter in the Loyalty program, You also need to be a member of the Osaka Bay Club; it is free, but You will have to provide your name/email/postcode to create your account; if You are already a member of Osaka Bay Club, You can enter into this Loyalty program by using the email address provided for the Osaka Bay Club membership.
  5. Enrolment to the Loyalty program is granted by means of one of the following platforms:
    1. In store

You will purchase any Sushi Daily product at one of the 10 kiosks participating to the Loyalty program. You will scan the QR code placed on the category label of the product which will direct You to the loyalty web application. Then, You will be asked to sign up (this is free of charge) to Osaka Bay Club account if you are not an existing  member (You will need to enter your email address, first and last name, date of birth, mobile number, town/city). 

You can only have an account per email address.

You will then be able to enter the alphanumeric code that will be revealed once the product has been opened, on the underside of the category label.

You can only use the code once.

The number of points earned will be tallied on your Osaka Bay Cub account.  

The rewards or discounts and tier levels to be redeemed will show on the web application. You will then be able to use them on your next purchases via Click &Collect. 

Once the discounts/awards have been redeemed, your points balance will be updated automatically. After the end of the Loyalty program on 2nd April 2023, unless the Loyalty program is extended, You won’t be able to redeem your earned points after this date. No carry over will be available to use on other Promoter’s programs. No refund will be available once discounts/awards have been redeemed.

  1. Online 

You will purchase any Sushi Daily product online from the Click and Collect platform of the Sushi Daily website. The points will be added automatically to your Click and Collect account and Osaka Bay Club account as You are already an existing member. If you are not already an existing member, You will have first to sign up (free of charge) to Osaka Bay Club account (You will need to enter your email address, first and last name, date of birth, mobile number, town/city).

The code can only be used once.

The rewards or discounts and tier levels to be redeemed will show in the rewards section of the loyalty platform. You will then be able to use them on your next purchases online.

Once the discounts/awards have been redeemed, your points balance will be updated automatically. After the end of the Loyalty program in June 2023, unless the Loyalty program is extended, you won’t be able to redeem your earned points after this date. No carry over will be available to use on other Promoter’s programs. No refund will be available once discounts/awards have been redeemed.

2.7 Both existing and new members of the Osaka Bay Club can unsubscribe from Osaka Bay Club at any time with the link available at the bottom of any Osaka Bay club communication email or any welcome email related to the Loyalty program.

  1. Limitation of liability
    1. The limit of the Promoter’s liability under these Terms and in connection with the Loyalty program will be exclusively to a Participant who suffers a direct loss as a result of a breach of these Terms by the Promoter and in those circumstances his sole liability will be to credit to the relevant Participant account such points as may have been wrongly deducted subject to customer providing evidence of the omission. 
    2. Nothing in these Terms shall operate to limit any liability the Promoter may have for death, personal injury or fraud.
    3. The Promoter accepts no responsibility for incomplete, incorrectly submitted, corrupted or misdirected registrations relating to any aspect of the program regardless of cause.
  2. Termination
    1. The Promoter reserves all rights to disqualify Participants at any time of the Loyalty program if Participant’s conduct is contrary to the spirit or intention of the Loyalty program or the Promoter’s brand and/or reputation.
    2. The Loyalty program in non-transferable. If the Participant doesn’t use the Loyalty program in line with the present Terms, the Loyalty program is cancelled, and the Promoter has no further obligations to the Participant.
    3. The Loyalty program is automatically terminated if the Promoter stops trading.
  3. Data protection and publicity

The Promoter will only process your personal information as set out in the https://sushidaily.com/gb-en/privacy

By entering the Loyalty program, the Participant agrees that its data be processed by the Promoter as well as by the Group's companies.

    1. The Promoter reserves the right to hold void, suspend, cancel, amend the Loyalty program where it becomes necessary to do so.

7.2 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

The Contest

The title of the contest is “SIGN UP TO WIN A TECH PACK” (the “Contest”).

How to enter

The Contest will be held from November 21st to March 31st.

To enter the Contest

a. For existing members of Osaka Bay Club

if you are already a member of Osaka Bay Club: refer the Tech Pack by sending an email to a friend who is not already a member of the Osaka Bay Club, if the friend signs up and ticks the box " I'd love to hear about awesome exclusives and promos" you will be entered in the Contest; if two or more friends will sign up your entry will only be counted once.

b. For those who are not members of Osaka Bay Club

You’ll will enter to the Contest by :

signing up to the Osaka Bay Club and by subscribing to the newsletter ticking the box " I'd love to hear about awesome exclusives and promos". To sign up to the Osaka Bay Club you will simply need to enter your email address, first name and postcode

 

c. For Belgium’s residents only

You will need to comply with a) or b) above and you will participate the Contest by answering correctly to the following question: What is the complete name (surname + name) of the Sushi Daily founder?

 

3.3 No purchase necessary and there is no charge to register as a member of the Osaka Bay Club.

3.4 Both existing and new members of the Osaka Bay Club can unsubscribe from Osaka Bay Club at any time with the link available at the bottom of any Osaka Bay club communication email.

3.5 The Promoter will not accept responsibility for Contest entries that are lost mislaid or damaged regardless of cause, including, for example, as a result of, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.6 By submitting a Contest entry, you are agreeing to be bound by these terms and conditions.

Eligibility

The Contest is open to people resident in the UK, France, Germany, Belgium, Spain, Denmark, Sweden, Finland, Netherlands, Nordics, Italy aged 18 years or over except:

employees of the Promoter or its holding or subsidiary companies or any subsidiary company of the Promoter’s holding company or other affiliated company;

anyone else associated with the Contest or its administration;

members of the immediate families or households of (a) and (b) above.

By entering the Contest, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof of your identity and that you are eligible to enter the Contest. The Promoter may withhold delivery of the Prize until it has received such evidence of identity and/or eligibility required by the Promoter from the Winner and failure to provide such evidence in a timely manner may result in forfeiture of the Prize.

The Promoter will not accept Contest entries that are:

automatically generated by computer in bulk or sent by bot;

illegible, have been altered, reconstructed, forged or tampered with; or

incomplete/false.

Contact information of the Contest entrant cannot be changed once the Contest entry form has been submitted.

Claiming the prize

6.1 One (1) entry will be randomly selected (“Winner”) from all the entries received during the Promotional Period using the platform https://www.random.org/.

6.2 The Winner will be notified by a private e-mail message through the Osaka Bay Club platform sent to the email address provided by the Winner at the time of entry into the Contest, as soon as practicable after the Closing Date. If a Winner does not respond during the seven day period to the email notification sent by the Promoter to the Winner, a new Winner will be randomly selected from the eligible entries which were received before the Closing Date

6.3 The Promoter does not accept any responsibility if the Winner is not able to take up the Prize and is not obliged to offer an alternative to the Prize if for any reason the Winner is not able to take up the Prize.

6.4 The Prize will be delivered by KellyDeli to the address given by the Participant on Osaka Bay Club.

Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or a Contest participant or accept any liability for any loss, damage, personal injury or death occurring as a result of the Winner accepting the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.

KellyDeli will not be responsible or liable if one or more items of the Tech Pack prize are unavailable on the day of the draw or in the country where the winner is based, and reserves the right to replace one or more items of the prize won with a prize of equivalent nature and value.

Termination

The Prize in non-transferable. If the Winner don’t use the Prize in line with the present T&Cs, the Prize is cancelled

and the Promoter has no further obligations to the Winner.

The Prize is automatically terminated if the Promoter stops trading.

Ownership of Contest entries and intellectual property rights

All Contest entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

The Promoter reserves the right to amend the Contest if the circumstances require it.

These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

4.1 The winner will be picked randomly from the pool of entries to the relevant contest post or stories (the “Winner”).

4.2 The Promoter will contact the Winner personally as soon as practicable via Instagram Direct Message or Facebook private message.

  1. The Prize

5.1 The prize for the Winner is one Sushi Daily Sharing Platter (the “Prize”) for the maximum amount of 45£

5.2 The Winner shall indicate three Sushi Daily kiosks of its preference. The Promoter will then select one of these that will be designated as the kiosk where the Winner can collect the Prize.

5.3 The Promoter might give the Winner a suggested time of the day when he/she can purchase the products with the Sushi Daily allowance.

5.4 The operational details will be provided to the Winner by the local representative of the Promoter, in accordance with the retailer rules under which we operate.

5.5 The Prize cannot be transfer / sold to another person or exchange for monetary value.

5.6 Only the Winner can claim and benefit of this Prize.

5.7 Upon visit to the designated Sushi Daily kiosk to claim the Prize, the Winner shall identify him/herself and/or show the online confirmation email provided by the Promoter.

5.8 If a given Winner does not collect the Prize on the designated day, in accordance with clauses above, he/she will not be entitled to move that sushi allowance to the next month and will lose the Prize.

  1. Claiming the prize

6.1 The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available or has not claimed his/her Prize within 7 calendar days of the announcement date, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the correct entries.

6.2 The Promoter has no responsibility if the Winner is not able to collect the Prize.

  1. Limitation of liability

7.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Statutory rights are not affected.

9.3 These terms and conditions shall be governed by English law, and each dispute or claim related to these terms and conditions shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

To sign up to the Osaka Bay Club you will simply need to enter your email address, first and last name, date of birth, mobile number, town/city. By entering the Contest, you will get the chance to win the Prize as defined below.
  2. How to enter
    • The Contest will run from 17th May 2022 (the "Opening Date") to 9th October 2022 (the "Closing Date") inclusive (the “Promotional Period”).
    • All Contest entries must be received by the Promoter no later than 11:59pm on the Closing Date. All Contest entries received after the Closing Date are automatically disqualified and will not be considered for selection in the draw.

      • illegible, have been altered, reconstructed, forged or tampered with; or
      • incomplete/false.
    • Contact information of the Contest entrant cannot be changed once the Contest entry form has been submitted.
    • The Promoter reserves all rights to disqualify entrants or the Winner at any time of the Contest if an entrant’s/Winner’s conduct is contrary to the spirit or intention of the Contest or the Promoter’s brand and/or reputation.
  2. Claiming the prize
    • The Promoter will make all reasonable efforts to contact the Winner. If a Winner does not respond during the seven day period to the email notification sent by the Promoter to the Winner, a new Winner will be randomly selected from the eligible entries which were received before the Closing Date.
    • The Promoter does not accept any responsibility if the Winner is not able to take up the Prize and is not obliged to offer an alternative to the Prize if for any reason the Winner is not able to take up the Prize.
  3. The prize
    • The prize (“Prize”) is a trip to Japan made by:

A two weeks trip to Japan including flight and accommodations for two people.

The maximum amount to be spent for the trip is equal 6,000 Euros.

The flight and accommodations will be booked via a travel agency indicated by the Promoter.

The Prize cannot be exchanged for monetary value or other products.

  • 2 The Prize needs to be used before the 31st of December 2024 (“Limit Date”). For all intents and purposes, it is thus specified that the journey must be made before this date.
  • 3 By exception in the event that the Winner demonstrates that the Prize could not be completed by the Limit Date due to the Covid 19 border closure in Japan, then the Promoter will exceptionally allow the Prize to be used up to and including December 31, 2025. After this date, the Prize will be lost and the Winner won’t be entitled to ask compensation for any ground whatsoever. 
  1. Limitation of liability
    • Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or a Contest participant or accept any liability for any loss, damage, personal injury or death occurring as a result of the Winner accepting the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.
    • The Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner if the latter is unable to take part in the Trip for personal reasons (including but not limited to illness, lack of valid identity documents).
  2. Termination
    • The Prize in non-transferable. If the Winner don’t use the Prize in line with the present T&Cs, the Prize is cancelled and the Promoter has no further obligations to the Winner.
    • The Prize is automatically terminated if the Promoter stops trading.
  3. Ownership of Contest entries and intellectual property rights
    • All Contest entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
  4. Data protection and publicity

    • If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Contest and/or suspend or terminate the Winner’s use of the Prize.
    • The Promoter reserves the right to hold void, suspend, cancel, or amend the Contest where it becomes necessary to do so.
    • These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
