SUSHI FOR LIFE CONTEST TERMS AND CONDITIONS 

 

1. The Promoter

The promoter is: KellyDeli UK Ltd, a company with registration number 09338288, whose registered office is at Office 06 – 113 WeWork, The Bower, 207 Old Street, London, EC1V 9NR (the “Promoter”).

2. The Contest

2.1 The title of the contest is “Sushi for Life” (the “Contest”).

2.2 The Promoter is organising the Contest to promote subscriptions to the Osaka Bay Club [website]. To sign up to the Osaka Bay Club you will simply need to enter your email address, first and last name, date of birth, mobile number, town/city. By entering the Contest, you will get the chance to win the Prize as defined below.

3. How to enter

3.1 The Contest will run from 12am (BST) on 7th September 2021 (the "Opening Date") to 12am (BST) on 21 November 2021 (the "Closing Date") inclusive (the “Promotional Period”).

3.2 All Contest entries must be received by the Promoter no later than 11:59pm on the Closing Date. All Contest entries received after the Closing Date are automatically disqualified and will not be considered for selection in the draw. 

3.3 To enter the Contest:

(i) if you are not already a member of Osaka Bay Club: you will enter the Contest by signing up to the Osaka Bay Club 

(ii) if you are already a member of Osaka Bay Club: you will automatically enter the Contest and you will receive an email notifying you that you have been entered into the Contest. If you don’t receive the email please contact [contact-uk@kellydeli.com].

3.4 No purchase necessary and there is no charge to register as a member of the Osaka Bay Club. 

3.5 Both existing and new members of the Osaka Bay Club can, at any time before the Winner is selected, withdraw from the Contest by unsubscribing from Osaka Bay Club, which link is available at the bottom of any Osaka bay club communication email.

3.6 The Promoter will not accept responsibility for Contest entries that are lost mislaid or damaged regardless of cause, including, for example, as a result of, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. 

3.7 By submitting a Contest entry, you are agreeing to be bound by these terms and conditions.

3.9 One (1) entry will be randomly selected (“Winner”) from all the entries received during the Promotional Period using this website https://www.random.org/.

3.10 The Winner will be notified by a private e-mail message through the Osaka Bay Club platform sent to the email address provided by the Winner at the time of entry into the Contest, as soon as practicable after the Closing Date. If a Winner cannot be contacted or is not available during the seven day period following the sending of the email notification by the Promoter to the Winner, a new winner will be randomly selected from the eligible entries which were received before the Closing Date. 

4. Eligibility

4.1 The Contest is open to all UK residents aged 18 years or over except:

(a) employees of the Promoter or its holding or subsidiary companies or any subsidiary company of the Promoter’s holding company or other affiliated company; 

(b) anyone else associated with the Contest or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

4.2 By entering the Contest, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof of your identity and that you are eligible to enter the Contest.  The Promoter may withhold delivery of the Prize until it has received such evidence of identity and/or eligibility required by the Promoter from the Winner and failure to provide such evidence in a timely manner may result in forfeiture of the Prize.

4.3 The Promoter will only accept one entry per person and not accept Contest entries that are:

(a) automatically generated by computer in bulk or sent by bot;

(b) illegible, have been altered, reconstructed, forged or tampered with; or

(c) incomplete/False

4.4 Contact information of the Contest entrant cannot be changed once the Contest entry form has been submitted.

4.5 The Promoter reserves all rights to disqualify entrants or the Winner at any time of the Contest if an entrant’s/Winner’s conduct is contrary to the spirit or intention of the Contest or the Promoter’s brand and/or reputation.

5. Claiming the prize

5.1 The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available, or has not claimed the Prize within 7 calendar days of the Promoter sending an email notification to the Winner confirming that she/he is the winning entrant, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

5.2 The Promoter does not accept any responsibility if the Winner is not able to take up the Prize and is not obliged to offer an alternative to the Prize if for any reason the Winner is not able to take up the Prize.

6. The prize

6.1 The prize (“Prize”) is a monthly voucher to the value of 70£  each month for a period of 30 years, which can be spent in a [specified] Sushi Daily kiosk on Sushi Daily products. The 30 (thirty) year period shall start upon receipt of confirmation from the Winner that he/she has received the Promoter’s notification that he/she is the Winner of the Contest (“Sushi Allowance Period”). 

6.2 […] 5 days after the selection of the Winner, the Promoter will agree with the Winner the Sushi Daily kiosk from which he/she can then use the Prize every month “(Home kiosk”).  

6.3 Sushi Daily products are those available as freshly prepared sushi (“Sushi Daily Products”), other products ranges might be available from time to time. 

6.4 The Winner shall, at the Promoter discretion, either receive an online voucher/loyalty card with an allowance worth 70£ which can be used in Sushi Daily Kiosks or a unique discount code which can be used to order Sushi Daily Products of up to 70£  using Sushi Daily click & collect.  

6.5 The Promoter will from time to time inform the Winner of the time of day when he/she can use the Prize.

6.6 The Winner is entitled to use the Prize during the Sushi Allowance Period to buy any Sushi Daily Products that are available at the Home Kiosks at that time, up to the value of any allowance remaining at the time of the specific purchase on the Winner’s voucher or displaying as the account balance in response to the Winner’s discount code (as applicable). The Promoter does not give any guarantee as to the availability of the Sushi Daily Products (or particular Sushi Daily Products) at the Home Kiosk during the Sushi Allowance Period.

6.7 The maximum value of the voucher available to be spent on Sushi Daily Products at the Home Kiosk (whether in a single transaction or a series of transactions) by the Winner is 70£ per month during the Sushi Allowance Period.  

6.8 Upon visit to a Home Kiosk to claim the Prize, the Winner shall identify him/herself and show the online voucher/loyalty card provided by the Promoter.

6.9 If the Winner does not use any or all of the monthly voucher value in any given month during the Sushi Allowance Period, the account balance remaining for that month cannot be retained and then used in subsequent months.  The Prize is not cumulative.  Any remaining balance at the end of any month in the Sushi Allowance Period will be reduced to zero and reset to 70 £ at the start of the subsequent month.

6.10 If the Prize is not used for a consecutive 12 (twelve) month period during the Sushi Allowance Period, then the Prize will lapse and becomes void.

6.11 The Prize cannot be exchanged for monetary value or other products.

7. Limitation of liability

7.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or a Contest participant or accept any liability for any loss, damage, personal injury or death occurring as a result of the Winner accepting the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. 

7.2 The Promoter does not guarantee that the Home Kiosk will continue trading throughout the Sushi Allowance Period. 

8. Termination

8.1 The Prize in non-transferable. If the Winner ceases to use the Prize for a consecutive 12 month period during the Sushi Allowance Period for any reason, then the voucher is cancelled for the remainder of the Sushi Allowance Period and the Promoter has no further obligations to the Winner.

8.2 The Prize is automatically terminated if the Promoter stops trading as a food company or ceases to operate Sushi Daily kiosks at any point during the Sushi Allowance Period.

8.3 If the Home Kiosk stops trading during the Sushi Allowance Period, the Prize will lapse automatically unless the Promoter and the Winner will make best efforts to identify another Home Kiosk.

8.4 The Winner may change his/her Home Kiosk up to [5] times during the Sushi Allowance Period, in agreement with the Promoter. Should the Winner wish to make this change, he / she should contact the Promoter on contact-uk@kellydeli.com.  The change may include a change of country. 

9. Ownership of Contest entries and intellectual property rights

9.1 All Contest entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

10. Data protection and publicity

The Promoter will only process your personal information as set out in the https://sushidaily.com/gb-en/privacy

11. General

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Contest and/or suspend or terminate the Winner’s use of the Prize.

11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Contest where it becomes necessary to do so.

11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.


SOCIAL MEDIA 12 DAYS OF SUSHI CHRISTMAS PLATTERS TERMS AND CONDITIONS 

1. The Promoter
2. The promoter is: KellyDeli Company Ltd, a company incorporated in United Kingdom with registered number 08765553 and whose office is at WeWork Floor 6, The Bower, 207 Old Street, EC1V 9NR, acting also on behalf of its subsidiaries (the “Promoter”).
3. The competition
3.1 The Promoter is organising a series of daily games, on the occasion of the coming Christmas season on social media for a chance of each Game participant to win a sushi sharing platter (the “Competition”).
4. How to enter
4.1 The Competition will run from 00:00 (GMT) on 1st December 2020 (the "Opening Date") to 23:59 (GMT) on 22nd  December 2020 (the "Closing Date") inclusive (the “Promotional Period”). However, each Game will be published across these days, both across stories and feed posts. 
4.2 All competition entries must be received by the Promoter via replying to the relevant Game via direct message or commenting the feed post on Instagram or Facebook, no later than  23:59 (GMT) on 22nd  December 2020 (the "Closing Date") All competition entries received after the Closing Date Time are automatically disqualified. 
4.3 To enter the competition:

• Watch the IG stories and reply with your guessed answer or comment the feed posts following the instructions in the caption
4.4 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. 
4.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
4.6 The Competition is in no way sponsored, endorsed, or administered by, or associated with Instagram or facebook. You are providing your information to the Promoter and not to Instagram or facebook. By participating in the Competition, you agree to a complete release of Instagram from any claims.
4.7 The Competition is subject to Instagram and Facebook’s terms of services which can be found at: https://instagram.com/about/legal/terms/ and https://en-gb.facebook.com/legal/terms.

4.9 Each winner will be picked randomly from the pool of correct entries to the relevant Game made during the Promotional Period

4.11 If a winner cannot be contacted or is not available, the Promoter reserves the right to disqualify them and select another winner from the pool of correct answers to the relevant Game.
5. Eligibility
5.1 The competition is open to France, Spain, Germany, Netherlands, Sweden, Denmark, Finland and UK residents only and aged 18 years or over but limited to, except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) anyone else associated with the Competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
5.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
5.3 The Promoter will not accept competition entries that are:
(a) illegible, have been altered, reconstructed, forged or tampered with; or
(b) incomplete.
5.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
6. The prize
6.1 The prize for each winner (hereinafter individually referred to as the “Winner’) is 1 (one) Sushi Daily sharing platter (the “Prize”) as follows:
• Location: the Winners shall indicate three Sushi Daily kiosks of their preference; The Promoter will then select one of these that will be designated as the kiosks where the Winner can collect the Prize.
• Time: the Promoter will give the Winner a suggested time of the day when he/she can use the prize.
• Product: the Winner is entitled to choose the Prize from the sushi big platter category of the Christmas campaign. In the exceptional circumstances that the chosen Sushi Daily kiosk is not able to create the chosen platter by the Winner, another platter of same value will be offered to the Winner.
6.2 Upon visit by each of the Winners to the designated Sushi Daily kiosk to claim the Prize, the Winner shall identify him/herself and/or show the online confirmation email provided by the Promoter.
6.3 If a given Winner does not collect the Prize on the designated date agreed with the Promoter, such Winner misses the possibility of picking up the Prize another day. 
6.4 The prize cannot be exchanged for monetary value.
7. Winners
7.1 The Promoter will contact the winner as soon as practicable after the Game Closing Time via Instagram Direct Message or Facebook private message where they send the competition entry. 
8. Claiming the prize
8.1 The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available, or has not claimed their prize within 7 calendar  days of the Announcement Date, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
8.2 The Promoter does not accept any responsibility if you are not able to take up the Prize.
9. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.   1. These Promotion Codes Terms and Conditions are supplemented by our Terms and Conditions of Sale, Terms and Conditions of Website and our Privacy Policy and they are binding upon you.
  2. Promotion codes are only valid for orders placed online on our Sushi Daily Click and Collect https://sushidaily.com/gb-en/click-and-collect.
  3. Minimum spend requirement is £10
  4. Promotion codes entitle you, at the time of ordering, to the saving indicated on the Promotion codes on that order placed with Sushi Daily Click and Collect.
  5. The Promotion codes must be entered into the Voucher Code field on the basket page and applied for the discount to be deducted from the order.
  6. Promotion codes are for personal and private use only by Osaka Bay members.
  7. KellyDeli reserves the right to decline to accept orders where, in its opinion, a Promotion codes is invalid for the order being placed.
  8. Promotions codes are valid until the date specified in the respective email.
  9. Only one promotion code can be used per order.
  10. Promotion codes are not valid in conjunction with any other promotion. Offer is not valid on sale items or other discounted items.
  11. KellyDeli reserves the right to change these Terms and Conditions at any time.

The Promoter may require you to provide proof of your identity and that you are eligible to enter the Contest.  The Promoter may withhold delivery of the Prize until it has received such evidence of identity and/or eligibility required by the Promoter from the Winner and failure to provide such evidence in a timely manner may result in forfeiture of the Prize.

4.3 The Promoter will only accept one entry per person and not accept Contest entries that are:

a) automatically generated by computer in bulk or sent by bot;

b) illegible, have been altered, reconstructed, forged or tampered with; or

c) incomplete/False

4.4 Contact information of the Contest entrant cannot be changed once the Contest entry form has been submitted.

4.5 The Promoter reserves all rights to disqualify entrants or the Winner at any time of the Contest if an entrant’s/Winner’s conduct is contrary to the spirit or intention of the Contest or the Promoter’s brand and/or reputation.

5. Claiming the prize

5.1 The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available, or has not claimed the Prize within 7 calendar days of the Promoter sending an email notification to the Winner confirming that she/he is the winning entrant, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

5.2 The Promoter does not accept any responsibility if the Winner is not able to take up the Prize and is not obliged to offer an alternative to the Prize if for any reason the Winner is not able to take up the Prize.

6. The prize

6.1 The prize (“Prize”) is one free side per day for one month, which can be collected in a [specified] Sushi Daily kiosk. 

6.2 Location: the Winners shall indicate three Sushi Daily kiosks of their preference; The Promoter will then select one of these that will be designated as the kiosks where the Winner can collect the Prize.

6.3 Time: the Promoter will give the Winner a suggested time of the day when he/she can use the prize.

6.4 Product: the Winner is entitled to choose one side from the sides range. In the exceptional circumstances that the chosen Sushi Daily kiosk is not able to offer the chosen side by the Winner, another side of the same value will be offered to the Winner.

6.5 Upon visit to the Sushi daily Kiosk to claim the Prize, the Winner shall identify him/herself and show the online confirmation email  provided by the Promoter.

6.6 If a given Winner does not collect the Prize on the designated date agreed with the Promoter, such Winner misses the possibility of picking up the Prize another day. 

6.7 The Prize cannot be exchanged for monetary value or other products.

7. Limitation of liability

7.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or a Contest participant or accept any liability for any loss, damage, personal injury or death occurring as a result of the Winner accepting the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.

10. General

10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Contest and/or suspend or terminate the Winner’s use of the Prize.

10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Contest where it becomes necessary to do so.

10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

  1. The Contest
    1. The title of the contest is “WIN A TRIP TO JAPAN” (the “Contest”).
    2. The Promoter is organising the Contest to promote subscriptions to the Osaka Bay Club https://sushidaily.com/gb-en/rewards. To sign up to the Osaka Bay Club you will simply need to enter your email address, first and last name, date of birth, mobile number, town/city. By entering the Contest, you will get the chance to win the Prize as defined below.
  2. How to enter
    1. The Contest will run from 17th May 2022 (the "Opening Date") to 31st August 2022 (the "Closing Date") inclusive (the “Promotional Period”).
    2. All Contest entries must be received by the Promoter no later than 11:59pm on the Closing Date. All Contest entries received after the Closing Date are automatically disqualified and will not be considered for selection in the draw. 
    3. To enter the Contest:
        1. if you are not already a member of Osaka Bay Club: you will enter the Contest by signing up to the Osaka Bay Club 
        2. if you are already a member of Osaka Bay Club: refer the Trip to Japan email to a friend who is not already a member of the Osaka Bay Club, if the friend signs up you will be entered in the Contest; if two or more friends will sign up your entry will only be counted once. 

b. For Belgium’s resident only 

        1. if you are not already a member of Osaka Bay Club: you will enter the Contest by signing up to the Osaka Bay Club and answering correctly to the following question: “how many kilometres separate Brussels from Tokyo ?”.
          1. If you are already a member of Osaka Bay Club: refer the Trip to Japan email to a friend who is not already a member of the Osaka Bay Club, if the friend signs up and if you answer correctly to the following question:“how many kilometres separate Brussels from Tokyo?” you will be entered in the Contest; if two or more friends will sign up your entry will only be counted once. 
    1. No purchase necessary and there is no charge to register as a member of the Osaka Bay Club. 
    2. Both existing and new members of the Osaka Bay Club can, at any time before the Winner is selected, withdraw from the Contest by unsubscribing from Osaka Bay Club, which link is available at the bottom of any Osaka Bay club communication email.
    3. The Promoter will not accept responsibility for Contest entries that are lost mislaid or damaged regardless of cause, including, for example, as a result of, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

    1. The Contest is open to people resident in the UK, France, Germany, Belgium, Spain, Denmark, Sweden, Finland, Netherlands aged 18 years or over except:
      1. employees of the Promoter or its holding or subsidiary companies or any subsidiary company of the Promoter’s holding company or other affiliated company; 
      2. anyone else associated with the Contest or its administration; or
      3. members of the immediate families or households of (a) and (b) above.

A two weeks trip to Japan including flight and accommodations for two people.

The maximum amount to be spent for the trip is equal 6,000 Euros.

The flight and accommodations will be booked via a travel agency indicated by the Promoter. 

The Prize cannot be exchanged for monetary value or other products.

6.2 The Prize needs to be used before the 31st of December 2024 (“Limit Date”). For all intents and purposes, it is thus specified that the journey must be made before this date. 

6.3 By exception in the event that the Winner demonstrates that the Prize could not be completed by the Limit Date due to the Covid 19 border closure in Japan, then the Promoter will exceptionally allow the Prize to be used up to and including December 31, 2025.  After this date, the Prize will be lost and the Winner won’t be entitled to ask compensation for any ground whatsoever.

    1. The Prize in non-transferable. If the Winner don’t use the Prize in line with the present T&Cs, the Prize is cancelled and the Promoter has no further obligations to the Winner.
    2. The Prize is automatically terminated if the Promoter stops trading.

    1. All Contest entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
